 Workshop follow-up: Main Themes Minimize

Here we report in brief the main themes that emerged at the workshop on Open Innovation and IPR that took place at the University of Manchester 26, 27 January 2009. Did we (as a group) miss something? Are you working on these topics? Let us know...
Here we have attempted to identify the main issues that arose from the presentations and discussions that took place at our recent GRIPS Early career Researcher workshop on OI and IPR. It will inform our current GRIPS work and perhaps can help researchers to focus their work in this interesting arena for the future.

The themes are presented under the three themes of the workshop, IPR frameworks, strategies of innovation actors, and policy actions.

IPR FRAMEWORKS
  • SMEs do not have the time/money to screen competition or to obtain patents
  • Locus of innovation in OI is a network rather than an individual firm
  • Issue of attorneys and malign interests
  • Rules and regs difficult to penetrate without attorney or expert
  • Commercialisation of innovation
  • Longterm ‘safety’ issues associated with informal rights
  • OI spirit of optimizing value of whole pie- IP spirit of individual value- clashing
  • Patented IP in standards, often not revealed until the standard is set

STRATEGIES OF INNOVATION ACTORS
  • Fear of getting involved in IP system- chilling effect on collaboration
  • Assigning one individual within an SME to look at IP valorisation
  • Need for pervasive top down OI strategy within the firm
  • Instances of OI vs. strategy of OI
  • Forced into OI rather than strategy of OI
  • SMEs saying patents aren’t relevant, ECRs saying yes they are
  • OI as PR boon- window dressing
  • Inability to opt out of the messy, expensive, constricting system

POLICY ACTIONS
  • Policy could support/fund SMEs in obtaining external IP and in patenting
  • Power relations in the network are unbalanced- needs policy addressing
  • Legal advice is available, but OI strategy advice is what is needed
  • Shelved, unused patents are ripe for OI inclusion
  • Importance of intermediary firms to connect unused patents and takers
